Can someone file a restraining order for emailing too much?

Is simply emailing someone a lot, if no threats are involved, enough for them to take action and file a restraining order against that person?
What would be considered proving a stalking case?

Does anyone know how to plant a spy bot onto someones computer? A hassle free way…
I’m not mad if that’s what you’re thinking. I have this guy stalking me online, and not so long ago when I downloaded spybot search and destroy it showed that I had 23 spybots on my system which freaked me out.
I think I’ve removed them all, because when I run the programme it shows I have no more on my computer but this guy still keeps emailing me telling me I have a nice myspace page just to wind me up. He even describes which graphics and photo’s or quotes I have on there and he isn’t in my friend list and my page is on private.
This guy is really creeping me out so what I want to do is try and spy on him back to see what his game is and put a stop to him. Any help will be appreaciated.Thanks
